2. Joint responsibility / joint control

Hoberg & Driesch Röhren Group companies maintain close supply and service relationships within the Group. Hoberg & Driesch GmbH & Co. KG also provides central departments and services for Group companies. These are mainly in the fields of human resources, IT, controlling, quality management/occupational safety and accounting. As part of this collaboration, companies also exchange personal data with each other.

The companies are then jointly responsible for processing personal data within the meaning of Article 26 of the European General Data Protection Regulation (GDPR). The Regulation requires companies to enter into a joint responsibility agreement (known as a "joint control agreement") and to communicate the main elements of this agreement to data subjects :

  • For all personal data and processing processes of the Hoberg & Driesch Röhren Group, Hoberg & Driesch GmbH & Co. KG has been designated as the main controller.
  • The joint data protection officer has been appointed as the central point of contact for data subjects. Data subjects are, however, free to address their data protection concerns to any of the Group's companies.
  • Both the companies themselves and their employees are obliged to respect the confidentiality of all personal data.
  • All obligations incumbent on companies under the GDPR fall on Hoberg & Driesch GmbH & Co. KG as the principal responsible party.
    All data protection and data security rules and measures of Hoberg & Driesch GmbH & Co. KG are adopted, enforced and applied by the other companies.

When exchanging personal data within the group, we rely on Article 6(1)(f) of the GDPR in conjunction with Recital 48 of the GDPR.

3. The collection and storage of personal data and the nature and purpose of their use

When you visit our website www.hoberg-driesch.de, the browser used on your terminal automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is captured without any intervention on your part:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the file accessed,
  • website from which access was made (Referrer-URL),
  • Browser used and, if applicable, your computer's operating system, as well as the name of your Internet service provider.

Logfile data is automatically rendered anonymous after 7 days. Once this period has elapsed, it is no longer possible to establish a link with an individual.

The above data is processed by us for the following purposes:

  • To ensure trouble-free access to our website,
  • to ensure a comfortable use of our website,
  • evaluate system security and stability, and for other
  • other administrative purposes.

The legal basis for data processing is Article 6, paragraph 1, sentence 1, point f) of the RGPD. Our legitimate interest derives from the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about your person.

Cookies

Our websites use so-called "cookies". They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit.

4. Data transmission

Your personal data will not be passed on to third parties for purposes other than those mentioned below. We will only pass on your personal data to third parties if :

  • if the transmission is necessary for the establishment, exercise or defense of legal claims in accordance with Art. 6, para. 1, sentence 1, point f) of the GDPR and if there is no reason to assume that you have an overriding legitimate interest in your data not being transmitted,
  • if there is a legal obligation to transmit your data in accordance with art. 6, para. 1, sentence 1, letter c) of the RGPD, as well as
  • if this is permitted by law and necessary for the performance of the contractual relationship with you in accordance with art. 6, para. 1, sentence 1, letter b) of the GDPR.

5. Analysis tools and integrated third-party offerings

Matomo:
We use the open source software Matomo (formerly known as "Piwik") to analyze and statistically evaluate the use of the website. We do not use cookies in this context.

The information is used to evaluate the use of the website and to enable us to tailor the design of our website to your needs. The information is not passed on to third parties. Under no circumstances are analysis results linked to other user data.

The tracking measures we use are carried out on the basis of Article 6, paragraph 1, sentence 1, point f) of the RGPD. With the tracking measures used, we want to ensure a responsive design and continuous optimization of our website. On the other hand, we use tracking measures to statistically record the use of our website and evaluate it with the aim of optimizing our offering for you. These interests are considered legitimate within the meaning of the aforementioned provision.

If the Do-Not-Track function is activated in your browser, your visit to our website will not be recorded by web tracking.

6. Do-Not-Track and opt-out indications

We take into account the Do-Not-Track setting in the browser. If the Do Not Track option is activated in the browser, tracking is deactivated.

  • request, in accordance with Article 15 of the GDPR, information about the personal data we process. In particular, you may request information on the purposes of the processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the intended retention period, the existence of a right of rectification, erasure, of rectification, erasure, restriction of processing or objection, the existence of a right of recourse, the origin of your data if it has not been collected from us, as well as the existence of automated decision-making, including profiling, and, where applicable, relevant information on the details thereof;
  • in accordance with art. 16 RGPD, demand without delay the rectification of inaccurate personal data or their completeness that we have recorded ;
  • in accordance with art. 17 RGPD, to demand the deletion of your personal data stored with us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims ;
  • to demand, in accordance with Article 18 of the RGPD, the limitation of the processing of your personal data, insofar as you dispute the accuracy of the data, the processing is unlawful but you refuse its erasure and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have requested the limitation of the processing of your personal data in accordance with Article 18 of the RGPD. 21 RGPD, you have objected to the processing;
    in accordance with art. 20 RGPD, to receive the personal data you have provided to us in a structured, commonly used and machine-readable format or to require their transmission to another controller;
  • in accordance with Article 7(3) of the GDPR, to revoke the consent you have once given us at any time with respect to us. This has the consequence that we can no longer continue to process data in the future that was based on that consent, and
  • to lodge a complaint with a supervisory authority in accordance with Article 77 of the RGPD. As a general rule, you can contact the supervisory authority at your usual place of residence, your place of work or our registered office.

8. Right to object

If your personal data is processed on the basis of legitimate interests in accordance with Article 6, paragraph 1, sentence 1, point f) of the GDPR, you have the right to object to the processing of your personal data in accordance with Article 21 of the GDPR, insofar as there are reasons related to your particular situation or if the objection is directed against direct advertising. When visiting our website, we use SSL (Secure Socket Layer) in combination with the highest level of encryption supported by your browser. As a rule, this is 256-bit encryption. We also use appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or total loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
